TRENTON, N.J.—A woman’s “bystander exposure” to asbestos from washing her husband’s work clothes for more than three decades substantially contributed to her mesothelioma, a New Jersey appellate court has ruled in upholding a $7.5 million jury award.
Friday’s ruling in Bonnie Anderson vs. A.J. Friedman Supply Co. Inc. upheld a jury award of $7 million for Ms. Anderson and $500,000 for her husband, plus prejudgment interest.
The couple brought product liability litigation naming several defendants that manufactured and supplied asbestos, but they went to trial only against Exxon Mobil Corp. after claims against the manufacturers were dismissed.
The plaintiffs alleged that Ms. Anderson contracted mesothelioma from one or two sources of asbestos exposures: her own 12-year employment working at an Exxon refinery and from laundering her husband’s asbestos-laden work clothes during his employment with Exxon from 1969 to 2003, according to court records.
Among other defenses, Exxon argued that Ms. Anderson’s claim was barred by the exclusive remedy provisions in New Jersey’s workers compensation law.
However, the appellate division of the Superior Court of New Jersey agreed with a trial court analysis that a “dual persona doctrine” applies when an employer undertakes “a completely separate and independent role with respect to the employee,” as was the case with Ms. Anderson’s nonoccupational asbestos exposure.

Health care reform regulations issued Wednesday by the Obama administration make clear that employers will be able to continue to impose cost-sharing requirements on preventive services employees receive from out-of-network providers.
Under the new law, beginning Jan. 1, 2011, employers with calendar-year plans will have to fully cover preventive services, such as screenings and immunizations, with no employee cost-sharing requirements. Grandfathered plans—those plans that do not, for example, ever increase coinsurance requirements or boost employee premium contributions by more than five percentage points—are exempt from the mandate to provide full coverage for preventive services.
But the law is unclear about whether the full-coverage mandate applies for preventive services delivered out of network. The new regulations end that uncertainty.

The Illinois Department of Insurance on May 28, 2010, ordered Roberto Garcia and RG International to stop transacting insurance business in the state and now has scheduled a June 23 public hearing on the case.
Garcia, individually and through his business entity, RG International, is alleged to have advertised, solicited and sold insurance policies and contracts, and collected premiums while not licensed as an insurance producer in Illinois. According to the department, Garcia’s producer’s license lapsed in October 2009 and his business entity, RG International, could not continue to operate without a licensed member.
Garcia and RG International are required to attend the hearing. It’s possible that Insurance Department Director Michael McRaith could impose additional sanctions, including fines at that time.
The public hearing will be held in the department’s Chicago office at 100 West Randolph Street, Suite 9-301.
